On February 2, 2019, at approximately 10:01 p.m., two Sacramento Police Department (SPD) officers were in police uniforms while driving a marked police vehicle in the area of San Juan Road and Northgate Boulevard. The officers observed the emergency flashers activated on a vehicle being driven in the area. A license plate check of this vehicle showed the registration to be expired as of January 2018, over a year expired. The officers activated their overhead red and blue police lights to initiate a traffic stop for expired registration.
The driver pulled into the parking lot of a gas station in the 3400 block of Northgate Boulevard. The officer who was driving the police vehicle made contact with the occupants. During the conversation, the driver advised that she did not have a driver’s license. The officer attempted to identify the male passenger who initially stated that his birthday was “1986.” After further questioning, he stated that his birthday was “January 17th,” of “92” and said he was “22” after the officer asked him his age.
The officer relayed to his partner that he felt the passenger was lying about his name. The assisting officer contacted the passenger to detain him for falsely identifying himself. During this contact, the passenger told the officer that he had a “gun.”
The officers safely detained the passenger by placing him in handcuffs. Then, the officers conducted a search of his person and located a firearm concealed in his waistband.
After detaining the passenger and safely recovering the firearm, the officers secured the firearm in the rear storage area of the police vehicle. The passenger was detained in the backseat of the patrol vehicle.
The firearm was later determined to be a .22 caliber Mossberg 715T. There was a magazine loaded into the magazine well, in addition to a live round loaded into the chamber. The magazine was loaded with 25 live rounds. See attached photo of the firearm and magazine.
The passenger was identified as 29-year-old Xeryus Davis. He was arrested for being a felon in possession of a firearm, being a felon in possession of ammunition, possession of an assault weapon and probation violation. See attached photo of the suspect.
The driver of the vehicle was later cited for driving without a license and released from the scene.

Through proactive work by our police officers such as this case, and partnerships with many community leaders, we stay committed to working together with our community to achieve meaningful results and ensure our city is policed safely and effectively.
A comprehensive approach of collaboration by law enforcement and community utilizing enforcement, intervention and prevention is necessary for us to reduce gun violence in our city.
Today SPD will release video material related to this incident. All video that will be released has been redacted to ensure the confidentiality and privacy of those involved. The faces have been blurred and audio redactions are signified by muted audio with no accompanying sound.

The release of this material is done at the discretion of the Chief of Police to inform our community on the complex, difficult and dangerous job of our police officers. This incident does not fall under the City Council policy on Police Use of Force.
