The Sacramento Police Department is recognizing two recent jury convictions in separate cases involving defendants who opened fire on Sacramento Police officers while they were performing their duties.
On October 13, 2026, a jury convicted Malcolm Wilcox of two counts of attempted murder, two counts of assault on a peace officer with a semiautomatic firearm, and being a felon in possession of a firearm. The jury also found true allegations that the attempted murders were committed against peace officers performing their duties, as well as firearm-use allegations. The conviction stems from an April 11, 2020, incident in which a Sacramento Police officer attempted to arrest Wilcox, who was wanted on an attempted murder warrant out of Yuba County. Wilcox fled from the officer before stopping his vehicle, exiting with a loaded semiautomatic firearm and firing multiple rounds at the officer. A second Sacramento Police officer arrived during the gunfire, and both officers returned fire. Wilcox continued firing at the officers before ultimately surrendering. Officers immediately rendered medical aid to Wilcox. Wilcox faces a maximum sentence of 74 years to life in prison. His sentencing is scheduled for November 13, 2026. In a separate case, on October 19, 2026, a jury convicted Jose Borrego of four counts of attempted murder with premeditation on a peace officer, along with multiple additional counts of attempted murder, assault with a firearm, shooting at an occupied vehicle, assault with a firearm on a peace officer, reckless evading of a police officer, and being a felon in possession of a firearm. The jury also found true multiple firearm-related allegations, including allegations involving the discharge of a firearm and causing great bodily injury. The charges stem from an April 14, 2022, series of incidents that began with reports of a man firing into occupied vehicles in south Sacramento. Later that day, Sacramento Police officers encountered Borrego while he was driving a vehicle matching the description from the earlier shootings. After initially stopping, Borrego fled at a high rate of speed. When officers later located him, Borrego was standing outside his vehicle armed with a handgun equipped with an extended magazine. He fired numerous rounds at responding Sacramento Police officers, striking their patrol vehicle several times. An officer returned fire before Borrego fled, prompting a multi-agency search. Borrego was ultimately located and safely taken into custody. Investigators later determined that evidence recovered from the earlier shootings was linked to Borrego's firearm.
Borrego faces a maximum sentence of 192 years and four months to life in prison. His sentencing is scheduled for November 6, 2026.
"These convictions send an important message that violence directed at our officers, or anyone in our community, will be taken seriously and those responsible will be held accountable," Sacramento Interim Chief of Police Zachary Bales said. "We are pleased with the outcome of these cases and grateful to the Sacramento County District Attorney's Office and the prosecutors who worked diligently to bring them to a successful conclusion. Our officers put themselves in harm's way every day to protect this community, and violence against them will not be tolerated."
The Sacramento Police Department thanks the Sacramento County District Attorney's Office and all of the law enforcement personnel whose work contributed to the investigation and prosecution of these cases.
